MINI SESSION TERMS & AGREEMENT

By completing your booking and payment, you agree to the following terms for your Fall Mini Session. These terms are intended to keep expectations clear and make the experience smooth for everyone.
1. Session Details
Your booking includes one 20-minute portrait session at Golden Gate Beach, Crissy Field, San Francisco, on the date and time selected during booking.
Payment is due in full at the time of booking and is required to reserve your session time.
2. Rescheduling and Cancellation
Session fees are non-refundable (see Sections 4 and 12 for the limited circumstances involving a refund).
If you need to reschedule, you may request to move your session to the other available Fall Mini Session date if the request is received at least 48 hours before your scheduled session. Rescheduling is subject to availability and is not guaranteed.
Cancellations do not qualify for a refund. Cancellations made less than 48 hours before the scheduled session, as well as no-shows, forfeit the session fee and are not eligible for rescheduling.
Mini-session payments cannot be transferred to another season or applied toward another photography service unless otherwise agreed to by Mdeacreative (see Section 3 for photographer-initiated postponements).
3. Weather and Location Conditions
Because these sessions take place outdoors, weather and site conditions can sometimes be unpredictable.
Mdeacreative will determine whether weather, air quality, site access, unsafe conditions, government restrictions, or other circumstances make the session impractical or unsafe.
If Mdeacreative postpones the session for one of these reasons, your payment will transfer to the other available mini-session date or a designated makeup date.
The planned location is Golden Gate Beach at Crissy Field. If access, safety, crowding, closures, environmental conditions, or other circumstances make the planned location impractical, Mdeacreative may adjust the meeting point or move the session to a reasonably comparable nearby location.
4. Photographer Cancellation or Inability to Perform
In the unlikely event that Mdeacreative is unable to photograph your session due to illness, emergency, equipment failure, location closure, or other circumstances beyond reasonable control, Mdeacreative may offer a rescheduled session, session credit, or refund of the amount paid.
Except where otherwise required by law, Mdeacreative's financial liability for an inability to perform the session will not exceed the amount paid for the session.
5. Arrival and Timing
Please arrive five to ten minutes before your scheduled session so you are ready to begin on time.
Mini sessions run on a fixed schedule to respect the families booked before and after you. Sessions begin and end at the scheduled times.
If you arrive late, your session will still end at the originally scheduled ending time, and you will receive the remaining portion of your session. Session time cannot be extended or rescheduled because of late arrival.
If you arrive after your scheduled session has ended, the booking will be considered a no-show.
6. Client Preparation and Cooperation
Mdeacreative will make reasonable efforts to create a variety of natural and flattering photographs during your session.
Clients are responsible for the readiness, cooperation, behavior, and supervision of everyone participating in the session.
Because people, especially young children and pets, can be unpredictable, Mdeacreative cannot guarantee specific expressions, poses, participation, or individual photographs.
Participant behavior or lack of cooperation does not qualify the session for a refund, reshoot, or additional photography time.
7. Image Selection and Delivery
You will receive an online gallery containing at least 15 professionally edited digital images within 14 calendar days of your session.
Mdeacreative retains artistic discretion over posing, composition, lighting, editing style, image selection, and the final photographs delivered.
Mdeacreative selects the strongest images from the session. Unedited photographs, RAW files, duplicate images, test images, and photographs that do not meet Mdeacreative's artistic or technical standards are not included or delivered.
Specific poses, compositions, or individual images cannot be guaranteed.
Online galleries are guaranteed to remain available for at least 60 days after delivery. Clients are responsible for downloading and backing up their photographs during that time. Mdeacreative does not guarantee indefinite archival storage of delivered images.
8. Copyright and Personal Use
Mdeacreative retains copyright to all photographs created during the session.
You receive a non-exclusive personal-use license to download, print, display, and share your delivered photographs for personal purposes, including personal social media.
Images may not be sold, licensed commercially, entered into commercial advertising, or significantly altered without written permission from Mdeacreative.
9. Model Release
Before completing your booking, you'll indicate below whether Mdeacreative may use photographs from your session for portfolio, marketing, and social media purposes. This choice is required and is made separately, outside of this agreement text.
If you authorize this use, Mdeacreative may display those photographs on its website, portfolio, social media, promotional materials, advertising, publications, and other business marketing channels. This authorization applies to your session as a whole, including other participating adults, unless a participant contacts Mdeacreative separately to opt out before the session.
If you decline, no photographs from your session will be used for marketing or promotional purposes.
For participating minors, the person providing permission confirms that they are the minor's parent or legal guardian, or otherwise have legal authority to provide that consent.
10. Outdoor Session Safety and Release
Sessions take place in a public outdoor environment and may involve sand, uneven or slippery surfaces, wind, water, changing tides, bicycles, pedestrians, animals, vehicles, and other natural or human-made conditions.
Clients are responsible for exercising reasonable care and for supervising children and pets throughout the session.
Mdeacreative may decline any pose, activity, or location that the photographer reasonably believes is unsafe and may stop a session if conditions or participant behavior create a safety concern.
Clients are responsible for their personal belongings during the session.
By participating in this session, Client releases, waives, and discharges Mdeacreative from any and all liability for injury, loss, or damage arising from participation in the session, except in cases of gross negligence or willful misconduct.
11. Minors
If your session includes children, the adult completing the booking confirms that they are the parent or legal guardian of each participating minor for whom they provide consent, or otherwise have lawful authority to authorize the child's participation.
A parent, legal guardian, or other responsible adult must supervise minors throughout the session.
The adult completing this booking releases Mdeacreative on behalf of any participating minor to the same extent described in Section 10.
12. Image Loss or Technical Failure
Mdeacreative takes reasonable precautions to protect photographs created during your session.
In the unlikely event that photographs are lost, damaged, corrupted, or otherwise unavailable because of equipment malfunction, storage failure, or circumstances beyond reasonable control, Mdeacreative may provide a rescheduled session or refund the amount paid.
Except where otherwise required by law, Mdeacreative's financial liability in such circumstances will not exceed the amount paid for the session.
13. Agreement
By checking the agreement box, indicating your model release preference, and completing payment, you confirm that you have read, understood, and agree to these Mini Session Terms & Agreement.
